1. Scope
These General Terms and Conditions (GTC) govern the use of the platform www.arvena.ch (hereinafter referred to as the ‘Platform’), which is provided by 4Me Group GmbH (hereinafter referred to as the ‘Operator’).
They apply to all registered doctors (‘service providers’) and patients (‘users’) of the platform.
By registering or using the platform, users and service providers agree to these GTC.
2. Purpose of the platform
Arvena.ch provides a digital infrastructure for communication between doctors and patients.
The platform is used exclusively for arranging and conducting telemedical consultations (video, chat, audio, etc.).
The operator itself does not provide any medical services and assumes no medical responsibility.
All medical statements, diagnoses and treatments are the sole responsibility of the respective doctor.
3. Registration and access
- Doctors must register with a valid licence to practise in Switzerland.
- The operator reserves the right to review or reject registrations.
- Patients must be of legal age and have legal capacity or have the consent of a legal representative.
- Access data (user name, password) must be treated as confidential.
4. Services provided by the operator
The operator provides technical resources for:
- Digital communication (video chat, messages, document transfer)
- User management
- Payment processing (if integrated)
- Secure data storage in accordance with the Swiss Data Protection Act
The operator is not obliged to guarantee the availability of the platform at all times. Maintenance, security updates or technical malfunctions may lead to interruptions
5. Responsibility of doctors
- Doctors are solely responsible for the accuracy and legality of their medical statements, diagnoses and treatments.
- They are obliged to comply with professional and ethical rules (FMH, MedBG, cantonal health laws).
- They must ensure that data protection and confidentiality are maintained.
- They may not carry out any treatments that are inadmissible or inappropriate in telemedicine.
6. Responsibility of users (patients)
- Users are obliged to provide truthful and complete information.
- Use of the platform does not replace emergency treatment – in acute cases, the emergency number 144 must be contacted.
- Users are responsible for the use of the medical information provided.
7. Data protection and data security
The operator strictly adheres to the Swiss Data Protection Act (DSG) and the General Data Protection Regulation (GDPR), where applicable.
Personal data is processed exclusively for the purpose of using the platform and is not passed on to third parties, except in cases of legal obligation or express consent.
Technical measures (e.g. SSL encryption, server location in Switzerland) ensure a high level of security.
A separate privacy policy regulates the details of data processing.
8. Disclaimer
- The operator accepts no liability for medical services provided via the platform.
- The operator is only liable for damages that can be attributed to intentional or grossly negligent behaviour on the part of the operator itself.
- No liability is accepted for data loss, system failures or transmission errors.
9. Payment processing
Insofar as the platform offers payment functions:
- Billing takes place directly between the doctor and the patient or via an integrated payment service provider.
- The operator may charge service fees for the use of the platform; these are shown transparently.
- The respective terms of payment apply.
10. Intellectual property
Use outside the scope of the contract is not permitted.
11. Changes to the GTC
Existing users shall be informed of significant changes in an appropriate manner.
12. Applicable law and place of jurisdiction
The place of jurisdiction is Pfäffikon SZ, unless mandatory legal provisions dictate otherwise.
